Terms of Use

These terms of use (hereinafter the “Terms of Use”) are intended to define and govern the terms of access to and use of the enix.io website (hereinafter the “Site”) and set out the respective rights and obligations of Enix (hereinafter the “Publisher”) and the user (hereinafter the “User”) in connection with the use of the Site.

Definitions

Content: All elements making up the information available on the Site (e.g., text, images, videos).

Services: Intellectual and/or technical services.

User: Any individual or legal entity who connects to the Site.

General Provisions

Any connection to the Site is subject to compliance with these Terms of Use.

By simply accessing the Site, the User acknowledges and confirms having read, understood, and accepted these Terms of Use in their entirety and without reservation.

The Company reserves the right to modify the Terms of Use, which will take effect as soon as they are published on the Site. Any changes will have no effect on purchases made on the Site prior to their publication, which remain subject to the Terms of Use as accepted by the User at the time each purchase was validated.

The User is invited to review the Terms of Use each time they use the Site’s Services, without the need for formal notice.

Description of the Site

The purpose of the Site is to provide information about the Publisher’s activities, and the Publisher strives to provide information that is as accurate as possible.

All information provided on the Site is for informational purposes only and is subject to change. Furthermore, the information on the Site is not exhaustive. It is provided subject to any changes made since it was published online.

To subscribe to the Services, the User must follow the steps in the process outlined on the Site. The User will fill in all fields required to identify themselves and select the Services and payment terms.

Access to the Site

The Publisher strives to make the Site accessible 24 hours a day, 7 days a week, except in cases of force majeure or events beyond the Publisher’s control, and subject to any outages or maintenance work necessary for the proper functioning of the Site and its services.

Consequently, the Publisher cannot guarantee the availability of the Site and/or Services, nor the reliability of transmissions and performance in terms of response time or quality. The Publisher’s liability cannot be engaged in the event of inability to access the Site and/or use the Services.

Furthermore, the Publisher may interrupt the Site or part of the Services at any time without notice, without any right to compensation. The Publisher will endeavor to inform the User in advance of the dates and times of the interruption. However, the User acknowledges and accepts that the Publisher is not responsible for interruptions and any consequences that may result for the User or any third party.

Site Hosting

The Site is hosted by a provider located within the European Union, in accordance with the provisions of the General Data Protection Regulation (GDPR: No. 2016-679). The goal is to provide a service that ensures the best possible availability rate. The hosting provider ensures continuity of service 24 hours a day, every day of the year. It nevertheless reserves the right to interrupt the hosting service for the shortest possible periods, in particular for maintenance purposes, infrastructure improvements, infrastructure failures, or if the Services generate traffic deemed abnormal.

Enix and the hosting provider cannot be held liable in the event of a malfunction of the Internet network, telephone lines, or IT and telephone equipment, particularly related to network congestion preventing access to the server.

Responsibilities of the Publisher and the User

The Publisher is responsible for the quality and accuracy of the Content it publishes and cannot be held liable for direct or indirect damage caused to the User’s equipment when accessing the Site, resulting either from the use of equipment that does not meet the necessary specifications or from the appearance of a bug or incompatibility. Accordingly, the User agrees to access the Site using up-to-date equipment, free of viruses, and with an up-to-date, latest-generation browser.

The information and/or documents available on the Site are subject to change at any time and may have been updated, particularly between the time they are downloaded by the User and the time the User becomes aware of them. It is therefore strongly recommended to verify the accuracy of the information and/or documents made available on this Site.

The User’s use of the information and/or documents available on the Site is at their own risk and sole responsibility. The User therefore assumes full responsibility for any consequences that may result, and the Publisher may not be held liable or pursued in this regard.

Under no circumstances may the Publisher be held liable for any damage of any kind resulting from the interpretation or use of the information and/or documents available on the Site. In particular, the Publisher cannot be held liable for indirect damages (such as loss of market share or loss of opportunity) resulting from the use of the Site.

Interactive spaces (the ability to ask questions in the “contact” section) are available to the User. The Publisher reserves the right to delete, without prior notice, any content posted in this space that violates applicable French law, in particular provisions relating to data protection. Where applicable, the Publisher also reserves the right to pursue the User’s civil and/or criminal liability, particularly in the event of racist, abusive, defamatory, or pornographic messages, regardless of the medium used (text, photograph, etc.).

Intellectual Property

The Publisher owns the intellectual property rights and holds the rights of use for all elements accessible on the Site, including text, images, graphics, logos, videos, icons, and sounds. Any reproduction, representation, modification, publication, or adaptation of all or part of the elements of the Site, by any means or process whatsoever, is prohibited without the Publisher’s prior written authorization.

Any unauthorized use of the Site or any of the elements it contains will be considered an infringement and prosecuted in accordance with the provisions of Articles L.335-2 et seq. of the French Intellectual Property Code.

Modification of the Terms of Use

The Publisher reserves the right to modify these Terms of Use at any time and without notice, in order to adapt them to changes to the Site and/or its operation.

The User declares that they accept the characteristics and limitations of the Internet, and in particular acknowledges that:

Incident Notification

Despite all efforts made, no method of transmission over the Internet and no method of electronic storage is completely secure. The Publisher therefore cannot guarantee absolute security.

If the Publisher becomes aware of a security breach, its Data Protection Officer will notify the affected User so that appropriate measures can be taken.

The Publisher’s incident notification procedures take into account its legal obligations, whether at the national or European level.

The Publisher undertakes to fully inform the User of all matters relating to the security of their account and to provide them with all the information necessary to help them meet their own regulatory reporting obligations.

No personal information about a User of the Site is published without the User’s knowledge, exchanged, transferred, assigned, or sold in any form to third parties. Only in the event of the acquisition of the Publisher and its rights would the transmission of such information to the potential acquirer be permitted, and the acquirer would in turn be bound by the same obligation to preserve and modify the data with respect to the User of the Site.

The Site may contain hyperlinks to other websites on the Internet. Links to these other resources take the User away from the enix.io site.

The User is authorized to create a link to the Site’s homepage without the Publisher’s express authorization. However, the Site should be displayed in a new browser window.

The Publisher reserves the right to request the removal of a link it deems inconsistent with the purpose of the enix.io site.

Applicable Law and Jurisdiction

Any dispute, claim, or litigation relating to the use of the Site is subject to French law, regardless of the place of use. In the event of a dispute, and after any attempt to find an amicable solution has failed, exclusive jurisdiction is granted to the competent courts of Paris.

If any provision set out in the legal notice or the Terms of Use is deemed illegal, invalid, or unenforceable pursuant to a law, a regulation, or a final decision of a competent court, all other provisions of the legal notice and the Terms of Use shall remain in effect.
